Regarding Swiss dashwork - Hybrid Working Solution

dashwork (aka Swiss dashwork) is a product of dashcom ltd. dashwork is a solution that enables the “Owner” as well as their respective Representatives of coworking spaces, corporates, organizations, business centers or similar locations to manage the use of their resources, named further the “Service”. “Users” or “End Users” are the consumers using the Service provided by dashcom and the resources provided by the Owner. For simplicity, all object types (meeting rooms, workspaces, parking spaces, lockers, etc.) are summarized under the term “resource”, for free or for a predefined fee. Individual “Users” are given the opportunity to book and use a resource using the Swiss dashwork App.
dashwork brings together multiple location-based services capabilities allowing the Owner to optimize the use of their resources or make a business pay, and the User to enhance location-based Services (for example, the User receives a notification in case of a ghost meeting booking, enabling the User to either confirm the booking or free the meeting room).
Relationship User – Owner: The contractual relationship between User and Owner is a short-term rental agreement of which dashcom is not a party. Each Owner defines groups with access, the User belongs to one of the authorized groups. The Owner therefore grants building and information accesses to Users, separately or as a group.
Relationship dashcom – Owner: dashcom and the Owner have a contractual relationship regarding the use of dashwork and service levels.
Relationship User – dashcom: Beyond the applicable conditions of using the Swiss dashwork application, there is no contractual relationship, factual or otherwise, between dashcom and the User. The Terms of Service must be approved from each User at the latest when committing to using a paid booking. By clicking on ”Approve” in the Swiss dashwork application, the User confirms that he/she has read and understood the Terms of Services. He/she agrees with the content.
Swiss dashwork is an application to manage resources and auxiliary services and facilitates the relationship between User and Owner. The Swiss dashwork application provides the User with the geographic location, the real-time availabilities, the commodities, the amenities, the prices, the conditions and other information received from the Owner.
However, dashcom does not own, create, resell, provide, control, manage, offer, deliver, or supply any resource and the Owner alone are responsible for their resources and their offerings. When “Users” make a booking, they are entering into a contract directly with each other. dashcom is not and does not become a party to or other participant in any contractual relationship between Owner and User, nor is dashcom a real estate broker or insurer. dashcom is not acting as an agent in any capacity for any Owner or User.
dashcom’s relationship with Users and Owners is limited to being solely an independent, third-party contractor.
Due to the nature of the internet, even though dashcom endeavors to take all necessary measures, it is not possible to guaranty uninterrupted availability and accessibility to the application. dashcom may improve, enhance, and modify the applications and services from time to time.
Data is stored on virtual servers, in a public cloud, hosted on Owner’s premise (Atlantica Cloud). Personalized data is hosted on virtual servers operated by the Owner in Switzerland. As the Owner has access to the User’s personalized data (“on premise” Installation), it is the Owner’s responsibility to take all necessary actions to ensure compliance with the Swiss regulation and duly inform the User in writing.
The dashwork Privacy Policy provides the User with all relevant information about privacy and personal data management, in full compliance with the Swiss regulations. The document is available in the dashwork App under Menu > Legal > Privacy Policy or under the following link
dashwork app may collect, use, store and transfer different kinds of personal and/or other related data about the User or the User’s company (hereinafter together referred to as the: “data”). In order to maximize User experience, dashwork app also collects, processes and uses Aggregated Data which may be derived from the User data.
The following data is gathered in order to provide the Owner or the Renter, with the dashwork features and benefits. It is about object based indoor location data, outdoor navigation (only GPS navigation from current Users position to Owner’s location (Campus Meilen, Zollikofen) via Users Navigation App and according to Users navigation apps legal terms), time, booking and payment information. For example, dashwork app may aggregate User Data to understand resources occupancy during a specific timeframe.
In order to enable automatic booking and occupancy monitoring, dashwork app monitors the presence of Users in different resources of Owners, such as meeting rooms, shared desks spaces, or other locations provided by the Owner, this in full compliance and respect of the Swiss regulations and the privacy policyThe evaluation of this data only allows personal conclusions to be drawn if the users have agreed to this in advance (“Find my Colleague” function).
The feature “Find my Colleague ” allows colleagues and contractors to locate the user, only and solely within the workspaces. The user approves the “Location sharing with my colleagues” by a manual action in the Swiss dashwork application settings. By default, “Location sharing with my colleagues” is disabled.
Personal Data security is ensured from encrypted data traffic, using secure Internet communication.
In order to enable billing, in the case of third-party spaces, the Owners will have access to personalized data based on the contractual relationship.
In order to create an account, there is a signup process. Before commencing this process, the Administrator aka. Owner must invite the User by Email. The Administrator is responsible for the invitation process. dashcom sets terms and conditions of use to the Owner, however, cannot be held liable for abuse or actions that breach those terms and conditions and will preserve the right to take action against such breaches.
Accurate current and complete information must be provided during the registration process.
Only one account per User may be established unless written consent states otherwise. Accounts cannot be transferred or assigned to any third party.
The responsibility for the confidentiality and security of the account credentials lies solely with the User. In the case of actual or suspected unauthorized use, user has to inform the service desk FOITT (Federal Office of Information Technology, Systems and Telecommunication) immediately.
Users must be able to enter legally binding contracts in order to access and use services provided by dashcom. By downloading the application or using the services this is confirmed by the user.
dashcom may make access and use of the application and services subject to certain conditions or requirements, such as a verification process, meeting certain qualities or criteria etc.
Access or use of certain 3rd party resources may be subject to separate policies from different owners, standards or guidelines or additional terms and conditions. The more specific conditions take precedence to the more general ones.
In order to book “paid resources”, user has to choose a third-party payment provider. This requires the acceptance of its “terms of service” and “privacy policy” by the user. The choice of a third-party payment provider is made in the Swiss dashwork app by forwarding the user to the chosen payment providers platforms. By using a third-party payment provider, users agree to its “terms of use” and “privacy policy”.
If the application is accessed or downloaded from the App Store and Google Play, the User agrees to Apple’s or Google Licensed Application End User License Agreement. Where Google Maps/Earth mapping services, including Google Maps API’s are used, they are subjected to the Google Maps/Google Earth Additional Terms of Services.
dashcom reserves the right to modify these Terms of Service at any time. Since the FOITT uses the dashwork solution “on premise”, changes to the “terms of service” can only be viewed and approved by the federal users after the FOITT has given its consent. Changes will be communicated by email. Should no written notification be made from a User within 30 days of the terms being made available online, they are deemed to be accepted.
Any content from dashwork or dashcom products and services are exclusive property of dashcom and/or its licensors or authorized third parties. No User may remove, alter, or obscure, or use any content without prior written consent of dashcom.
Subject to compliance with these terms, dashcom grants a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to download the application onto the personal device of the User, access any content made available on or through the dashcom app and website accessible to the User, solely for personal and non-commercial use.
dashcom may receive commissions for every transaction made when User rent a resource against a fee. Unless otherwise agreed between the Owner and dashcom, the commission is deducted directly from the amount to be transferred to the Owner.
User are charged according to the terms of the selected payment service provider. At any time, the User can trace the expenses and historical data in the dashwork App.
Any questioning or contesting of the report must first be initially addressed to the Owner (dashwork@bit.admin.ch). The Owner will review any such questions or corrections. If the issue cannot be resolved, dashcom will support the Owner with resolving the issue, providing it falls into a competence of dashcom.
For priced booking, the cancellation conditions are stated on the details pages of the resource in question, in the Swiss dashwork App.
Depending on the cancellation policy in force, the User may cancel the booking for a fee or at no charge.
If credit card details are entered into dashwork, we will verify that the provided credit card is associated with a valid, open account and can be successfully charged. We do this via payment gateway verification facilities (all communication with the payment gateway is done through an industry-standard SSL connection). This does not result in the deduction or reservation of any funds, however in some cases of charged bookings cardholders may see a temporary authorization for a small mount on their account after their card has been verified. The authorization will fall off the cardholder’s account within a few days and will never settle.
Any taxes due and owed by either the User or the Owner are their sole responsibility. dashcom cannot be held liable for VAT or any similar taxes, nor the collection thereof. It is the Owner’s responsibility to communicate if such taxes are to be raised or not.
Owners of the resources set the specific terms and conditions of use of the resources. dashcom is not responsible and cannot be held liable for the terms and conditions set by the Owner, nor for any damages of any kind created by a User.
In case of a dispute between Owner and User, dashcom is neither contractual nor any other kind of participant or party to such a dispute, as the contract is between Owner and User. However, dashcom endeavors to support dispute resolution between the parties.
dashcom can expressly not be held liable for the following non-exhaustive list of occurrences:
– Property damages to the resource
– Damages for personal or bodily injury or emotional distress
– For the use of or inability to use dashwork or any other service from dashcom
– Liability for any and all occurrence, which cannot be excluded or limited under applicable law
– Any kind of inappropriate, unlawful, improper use of dashwork or products from dashcom.
In the case of any kind of inappropriate, unlawful, improper use of dashwork or products from dashcom, dashcom has the right to demand compensation for damages.
It is the User duty not to block Swiss dashwork on mobile phone. The User is solely responsible to keep the mobile phone up and running and connected to the web, using the mobile phone network or WIFI network.
In the case of failure to respect the above, the User might be charged for the use of the resource until the end of day. E.g., If the User keeps his/her vehicle parked for a longer period of time without having previously duly booked the parking space.
In the case of a dispute dashcom is to be contacted in writing concerning the matter in order to open an informal negotiation procedure. The negotiation procedure has no impact on deadlines set by the law to file a suite.
To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Swiss Law.
Applicable is exclusively Swiss law. Place of Jurisdiction is the seat of dashcom SA.
